This Portable Restroom Service Agreement (“Agreement”) is entered into between GLD Construction Services Inc, a Florida corporation, doing business as Waste Regulators (“Company”), and the customer (“Customer”).
This Agreement governs the delivery, placement, servicing, and removal of portable restrooms and related equipment (“Units”) provided by Company. By signing below, Customer agrees to all terms and conditions contained herein.
1. Services
Company will deliver, place, service, and remove Units at the location Customer designates.
Units at job sites are serviced at least once per week. Each service visit includes pumping the waste tank, restocking supplies, cleaning and sanitizing the interior, and inspecting the Unit.
Units at special events are serviced as agreed in writing, and at least once per day during multi-day events, as required by Florida law.
Additional service visits are available on request and will be billed at Company’s current rates.
Units remain the property of Company at all times.
2. Billing
Job-site Units are billed in 28-day cycles beginning on the delivery date. Each cycle includes weekly service. Billing continues each cycle until Customer notifies Company to remove the Units and the Units are picked up.
Special events are billed at the flat per-event price quoted to Customer.
Customer agrees to pay all applicable charges, including but not limited to:
- Delivery, relocation, and removal charges
- Additional or emergency service visits
- Trip charges at Company’s current rates if a Unit is inaccessible, blocked, or locked at the scheduled service time
- Extra cleaning or contamination fees for misuse (see Section 5)
- Repair or replacement costs for damaged, lost, or stolen Units (see Section 6)
3. Payment terms
Payment is due on or before the due date specified on the invoice.
Past due balances may incur a late fee of 1.5% per month (18% annually), or the maximum allowed by law.
Customer agrees to pay all costs of collection, including attorney fees, court costs, and collection agency fees.
Company reserves the right to suspend Services or remove Units if Customer’s account becomes delinquent.
4. Placement and access
Customer will provide a firm, level location for each Unit that the service truck can reach safely. Units should be placed on solid ground, away from slopes, drainage areas, and overhead hazards.
Customer will keep a clear path to each Unit on scheduled service days. Customer is responsible for any gate codes, keys, or site access needed for service.
Customer is responsible for obtaining any permission required to place Units, including from property owners, homeowners associations, venues, or local authorities.
Florida law requires restroom facilities at building sites to remain accessible whenever workers are present. Customer agrees to keep Units accessible to their intended users.
Customer shall not move Units from their original placement without Company approval. Relocation by Company will be billed at current rates.
5. Proper use and prohibited materials
Units are for human waste and toilet paper only. Customer agrees that the following will NOT be placed in Units:
- Trash, debris, or construction materials
- Hazardous waste, chemicals, paints, solvents, fuels, or oils
- Concrete, mortar, drywall mud, or paint washout
- Medical waste, needles, or sharps
- Diapers, wipes, or other items that cannot be pumped
- Any material prohibited by local, state, or federal law
Customer will pay for extra cleaning, contamination removal, graffiti removal, or disposal costs caused by misuse of any Unit.
6. Customer responsibility for Units
Customer is fully responsible for Units while they are on Customer’s site or under Customer’s control.
Customer agrees to pay the full repair or replacement cost for any loss, theft, vandalism, fire damage, tip-over damage, or other damage beyond normal wear and tear.
Customer will notify Company promptly if a Unit is damaged, tipped over, vandalized, or in need of service.
7. Weather and hurricanes
Company may secure, relocate, or temporarily remove Units ahead of tropical storms, hurricanes, or other severe weather. Customer will provide access for this purpose.
Company is not responsible for damage to Units, property, or persons caused by wind, flooding, or other weather events. Customer remains responsible for Units left on site during severe weather.
8. Florida requirements
Florida Administrative Code Rule 62-6.0101 sets minimum numbers of portable restrooms for building sites and special events. Company will recommend a number of Units based on the information Customer provides. Customer is responsible for providing accurate headcounts and hours and for ordering enough Units for its site or event.
For special events, Florida requires the event organizer to provide the Department of Environmental Protection with a signed contract with the restroom service company at least one working day before the event. Company will provide the contract details. Filing is the responsibility of the event organizer.
Where food is served, Florida requires hand washing facilities in proportion to the number of portable restrooms. Unless Company agrees in writing to provide them, Customer is responsible for meeting this requirement.
9. Removal and right to retrieve Units
Customer will notify Company when Units are no longer needed. Units must be accessible for pickup on the scheduled removal date.
Company may enter Customer’s property to retrieve Units without notice if necessary, including in cases of nonpayment or termination of Services. Customer waives claims for damages arising from such retrieval.
10. Site conditions
Customer acknowledges that service vehicles are heavy and may cause surface damage. Customer assumes responsibility for damage to driveways, pavement, lawns, landscaping, irrigation systems, septic systems, and underground utilities along the access path and at the placement location. Company is not responsible for such damage.
11. Indemnification
Customer agrees to indemnify, defend, and hold harmless GLD Construction Services Inc, dba Waste Regulators from any claims, damages, losses, fines, penalties, liabilities, or expenses arising from:
- Customer’s use of Units or Services
- Misuse of Units by Customer, its workers, guests, or the public
- Customer negligence
- Violation of any applicable law or regulation
12. Service interruption
Company shall not be liable for delays or inability to perform Services due to weather, traffic, site access problems, equipment failure, or events beyond Company’s control.
13. Entire agreement
This Agreement represents the entire agreement between Company and Customer regarding portable restroom Services unless otherwise agreed in writing. If Customer also receives dumpster Services, those Services are governed by the Waste Regulators Account Agreement.
